Welcome to Zapoll, a digital survey and feedback platform operated by The Morning Owl Sdn. Bhd. (202501015530 / 1616945-K) (“Zapoll”, “we”, “us”, or “our”).
By registering an account or accessing Zapoll (the “Platform”), you agree to comply with the following Terms of Use, privacy policy, points & coupon expiry policy, prohibited content policy.
If you do not agree to these Terms, please discontinue using Zapoll.
1. Definitions
Account – A user profile registered on Zapoll.
User – Any individual who registers, logs in, or uses the Platform.
Creator – A registered user who creates surveys/forms.
Respondent – A user who answers surveys/forms.
Points – Digital reward points earned by Respondents through participation and redeemable for coupons within the Platform.
Coupons – Digital vouchers offered by Zapoll for redemption using Points.
Services – Includes the Platform, survey tools, analytics, user dashboards, reward systems, communication tools, and any features Zapoll provides.
Malaysia PDPA – Personal Data Protection Act 2010 governing data handling in Malaysia.
2. Eligibility
You must:
Be at least 13 years old; and
Reside in Malaysia; and
Provide accurate information when registering.
If you are below 18 years old, parental or guardian consent is required to use the Platform or redeem rewards.
3. License to Use
Zapoll grants you a non-exclusive, non-transferable license to access and use the Platform according to these Terms.
You must not:
Reverse engineer, copy, or tamper with Zapoll’s systems
Attempt to manipulate points, responses, or survey results
Use bots, automated scripts, or fraudulent identities
Harass, abuse, or impersonate any individual
Upload harmful content (malware, viruses, illegal materials, etc.)
Publish or submit offensive, hateful, or discriminatory content
4. User Responsibilities
By using Zapoll, you agree to:
Keep your login credentials private
Ensure all information provided is accurate
Use the Services only for lawful purposes
Not misuse Points, Coupons, or reward systems
Not share confidential survey content without permission
Creators additionally agree to:
Ensure their surveys are legal and appropriate
Not collect sensitive personal data unless required and fully disclosed
Respect respondents’ privacy and PDPA requirements
Not to misuse user data obtained through surveys
Respondents additionally agree to:
Answer surveys truthfully and without automation or fraud
Not attempt to exploit points or coupons by creating multiple accounts
5. Service Availability & Suspension
Zapoll may:
Add or remove features
Update or upgrade the Platform
Conduct maintenance that may temporarily disable access
Suspend or disable accounts involved in suspicious, fraudulent, or illegal activity
You will be notified where possible, but downtime may occur without notice.
6. Intellectual Property
All content, branding, system designs, and technology in Zapoll are the property of: The Morning Owl Sdn. Bhd.
Unless explicitly permitted, users may NOT:
Copy or reproduce any part of the Platform
Use Zapoll’s trademarks or branding
Scrape or extract Platform content for commercial use
7. Limitation of Liability
Zapoll is provided “as is” and “as available”, without warranties.
To the fullest extent permitted by Malaysian law, Zapoll is not liable for:
Loss of profits
Loss of data
Inaccurate survey or poll responses
Unauthorized account access (if caused by your negligence)
Points/coupon losses due to maintenance, errors, or account misuse
We are only liable up to the maximum extent allowed by Malaysian law.
8. Termination
Zapoll may suspend or terminate an account if:
Fraud, multiple accounts, or dishonest activity is detected
A user submits harmful, abusive, or illegal content
A user violates these Terms or PDPA requirements
Users may deactivate their account at any time via account settings.
9. Governing Law
These Terms are governed by the laws of Malaysia.
Any disputes shall be heard exclusively in the courts of Malaysia.
